If you've really been wronged (and I think we all know when we've really been wronged and when sh*t just happens) then you owe it to yourself to put your grievence in writing (printed, not e-mail). The "CC: NYS Attorney's General" line is the clincher. Heck, this is a major reason why we the tax-payers have an Attorney's General. Based on the story you told us in this thread, Toshiba at least owed you a new (and properly working) TV or the money back.
Toshiba needed to make you very happy with the resolution. The AG's office will probably follow up to make sure you are satisfied with the remedy. (And Toshiba may require you to report your satisfaction to the AG's Office as part of the deal.) Hypothetically, if you were to reject Toshiba's offer, citing that they owe ALL New York State owners of that model TV a new TV, our man Mr. Spitzer would have a big case to go after... and he just might.

**** UPDATE ****
Toshiba 57HX94 arrived DOA Friday. I finally had it with Toshiba waiting for so long. I requested my money back and the customer service supervisor has granted this request and I will have a full refund with tax sent to me via check.
I have set my sights on the new Samsung 61" DLP 1080P model number HL-R6168W. It will be out by mid June.

***Update on Toshiba***
I received a full refund with tax from Toshiba. It took 6 weeks from the time they took my tv to get the check.
***Update on New TV***
Samsung has delayed the release of the 6168 (1080p) until July. I have changed my mind on the DLP after watching tv on a Samsung 6167 at a neighbors home. I did not have any complaints, but some people watching complained about headaches...I throw alot of parties around TV events (Soccer World Cup, NBA Finals, World Series , Super Bowl, Daytona 500, etc...) and I don't want my guest complaining, because of this I have re-evaluated the technologies LCD, DLP , PLASMA & LCOS and wanted to go with Plasma. But I'm the new owner of a JVC HD-ILA 61Z786 courtesy of a Father's Day present from my family.
